Agreement to Terms
These Terms of Service govern your use of Maple Trail's website and travel services. By accessing our website or booking our services, you agree to be bound by these terms.
If you do not agree with any part of these terms, please do not use our website or services. We recommend reading these terms carefully before making any bookings.
1. Definitions
For the purposes of these terms:
- "Services" refers to travel planning, booking coordination, and related services provided by Maple Trail.
- "Traveler" or "You" means any person accessing our website or using our services.
- "Journey" includes all travel experiences, programs, and activities we arrange.
- "We," "Us," or "Our" refers to Maple Trail and its representatives.
- "Partners" includes accommodation providers, transportation companies, activity operators, and Indigenous communities we work with.
2. Eligibility and Use of Services
Age Requirements
You must be at least 18 years old to book our services independently. Minors may participate in journeys when accompanied by a parent or legal guardian who accepts responsibility for their participation and conduct.
Accurate Information
You agree to provide accurate, current, and complete information during the booking process. This includes contact details, health considerations, accessibility needs, and emergency contacts. Inaccurate information may affect our ability to deliver appropriate services.
Account Responsibility
If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Booking and Payment Terms
Booking Process
Bookings are confirmed upon receipt of required deposit and signed agreement. We will provide a detailed itinerary, cost breakdown, and terms specific to your journey. Availability is subject to confirmation with our partners.
Payment Schedule
Typical payment structure includes:
- Deposit of 25-30% due upon booking confirmation
- Balance payment due 60 days before journey departure
- Specific payment terms will be outlined in your booking agreement
Accepted Payment Methods
We accept major credit cards, debit cards, bank transfers, and certified checks. All payments are processed in Canadian dollars unless otherwise specified. Currency conversion fees may apply for international payments.
Price Changes
Once your booking is confirmed and deposit received, the price will not change except in cases of significant increases in fuel costs, taxes, or exchange rates beyond our control. We will notify you of any necessary adjustments.
4. Cancellation and Refund Policy
Cancellation by Traveler
Cancellation fees apply as follows:
- More than 60 days before departure: Full refund minus 10% administrative fee
- 30-60 days before departure: 50% refund of total cost
- Less than 30 days before departure: No refund, full payment required
These terms reflect commitments made to our partners on your behalf. We strongly recommend travel insurance to protect against unforeseen circumstances.
Cancellation by Maple Trail
We reserve the right to cancel journeys due to insufficient enrollment, safety concerns, or circumstances beyond our control. In such cases, you will receive a full refund or may transfer your booking to an alternative date without penalty.
Medical and Emergency Cancellations
We understand that health emergencies and family circumstances arise unexpectedly. While our standard cancellation terms apply, we will work with you compassionately and may offer alternative solutions when possible. Travel insurance is strongly encouraged.
Itinerary Changes
If you request changes to a confirmed booking, we will accommodate when possible. Change fees may apply depending on timing and nature of modifications. Changes requested within 30 days of departure may not be possible.
5. Travel Requirements and Responsibilities
Travel Documents
You are responsible for obtaining and maintaining valid passports, visas, and other travel documents required for your journey. We provide guidance but cannot guarantee approval of applications or entry into any destination.
Health and Fitness
Certain journeys require specific fitness levels. You must honestly assess your physical capabilities and disclose any health conditions that might affect your participation. We provide detailed activity descriptions to help you make informed decisions.
Travel Insurance
We strongly recommend comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and personal belongings. Insurance is your responsibility and should be purchased at the time of booking.
Conduct Expectations
Travelers are expected to conduct themselves respectfully toward guides, partners, Indigenous communities, other travelers, and local customs. We reserve the right to remove travelers from journeys if behavior becomes disruptive or disrespectful, without refund.
6. Liability and Disclaimers
Services as Arranged
Maple Trail acts as an intermediary arranging services provided by independent suppliers including hotels, transportation companies, and activity operators. While we carefully select partners, we are not liable for their actions or omissions.
Limitation of Liability
Our liability is limited to the fees paid for our services. We are not responsible for indirect damages including lost wages, vacation time, or opportunity costs. This limitation applies to the fullest extent permitted by law.
Force Majeure
We are not liable for failure to perform services due to circumstances beyond our reasonable control including natural disasters, weather events, political instability, pandemic, strikes, or government actions. In such cases, we will work to provide alternatives when possible.
No Warranties
While we strive for excellent experiences, we cannot warrant specific outcomes or results from your journey. Travel involves inherent uncertainties including weather, wildlife sightings, and human interactions that are beyond our control.
Assumption of Risk
Travel, particularly in natural environments, involves inherent risks. You acknowledge and accept these risks including injury, illness, property loss, or inconvenience. You agree to follow safety instructions provided by guides and partners.
7. Intellectual Property
All content on our website including text, images, logos, and itinerary designs are protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without written permission.
During Indigenous cultural programs, knowledge keepers retain intellectual property rights to their stories, teachings, and cultural information. Travelers may not record, photograph, or share sacred knowledge without explicit permission.
8. Privacy and Data Protection
Your personal information is handled according to our Privacy Policy, which forms part of these terms. We collect and use data necessary to provide services and maintain communication.
By using our services, you consent to data sharing with partners as necessary to facilitate your journey. All partners are required to protect your information appropriately.
9. Dispute Resolution
Informal Resolution
If you have concerns about our services, we encourage you to contact us directly first. Most issues can be resolved through open communication and mutual understanding.
Mediation
If informal resolution proves unsuccessful, we agree to attempt mediation through a mutually agreed mediator before pursuing legal action. Mediation costs will be shared equally.
Governing Law
These terms are governed by the laws of British Columbia and Canada. Any legal proceedings will be conducted in courts located in Vancouver, British Columbia.
Time Limitations
Claims related to services must be filed within one year of the journey completion date. Claims not filed within this period are waived.
10. Modifications to Terms
We may modify these terms periodically to reflect changes in our practices, legal requirements, or business operations. Material changes will be communicated to travelers with confirmed bookings.
Continued use of our services after changes are posted constitutes acceptance of modified terms. We encourage you to review these terms before each booking.
11. General Provisions
Entire Agreement
These terms, together with your booking agreement and our Privacy Policy, constitute the complete agreement between you and Maple Trail regarding our services.
Severability
If any provision of these terms is found unenforceable, the remaining provisions will continue in full effect. The unenforceable provision will be modified to reflect the parties' intent.
No Waiver
Our failure to enforce any provision does not waive our right to enforce it later or other provisions. All rights and remedies are cumulative.
Assignment
You may not transfer your booking or rights under these terms without our written consent. We may assign our rights and obligations to qualified successors.
